Much like commercial property, the Firm advises both private and commercial clients on a broad range of issues including the acquisition, disposal, letting and development of residential property. This work can also include standard residential conveyancing, portfolio transfers, transfers of equity, preparation of option agreements, refinancing, and landlord and tenant litigation.

The main types of residential property work we are instructed on are described below.

Conveyancing

We regularly act for domestic and overseas investors on the acquisition and sale of residential properties, and occasionally act for clients buying or selling their homes. Given the profile of the Firm’s clients, typically the properties are located in Central and Greater London, with the occasional property being further afield.

The Firm provides a bespoke service on each conveyancing transaction, and clients are given as much support and guidance as they require. All of the Firm’s property solicitors are able to deal with conveyancing transactions, ably assisted by the Firm’s paralegals and trainee solicitors.

Lease Extensions & Freehold Enfranchisement

The Firm regularly acts for both landlords and tenants, but predominantly for tenants, in connection with both statutory and voluntary extensions of flat leases. Premiums paid by tenants have ranged from £6,000 to over £100,000, and the Firm is currently instructed on an extension of a lease for a flat in Paddington for which the premium is likely to be in excess of £500,000.

The Firm also acts for both landlords and tenants in connection with the sale and acquisition of freeholds by tenants, including recently acting for 7 tenants in a converted house block in Paddington and 14 tenants in a purpose-built block in Fulham.

Portfolio Transfers

We act for private property owners who wish to transfer portfolios into LLP or company structures for tax efficiencies, which involves liaising with tax advisors, fulfilling landlords’ requirements (if leasehold), satisfying lender’s requirements, preparing transfer deeds, and dealing with post-completion formalities.
